Around-the-Island Swim Support (Water and Land) 2025
This relay would be impossible without our amazing water- and land-based volunteers! Accompany swimmers in a kayak or stand-up paddleboard, or provide support in your motorboat. Prefer solid ground? There are land-based volunteer opportunities as well: talk with folks about the swim and AAB's mission at our information tables at T&C and Safeway, help swimmers and kayakers/SUPers enter and exit the water at various locations, register participants at the Arms Across Blakely swim, or "be a beacon"-- wear a highly visible garment so swimmers and their guides can spot their destination from the water! WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT
In consideration of being allowed to participate in any way in Arms Around Bainbridge sponsored open water swim events, including the Arms Across Blakely fun swim, the undersigned acknowledges, appreciates and agrees that:
ASSUMPTION OF RISK
Open water swimming, kayaking, and boating are each inherently dangerous and there is a possibility that I may suffer property loss, serious injury or death as a result of my participation in the event. Swimmers and boaters can be hard to see, and Arms Around Bainbridge cannot minimize or eliminate the risks of a natural, public environment. I knowingly and freely assume the risks or participating in the event including but not limited to the following: water conditions such as temperature, currents, waves, weather, floating objects, wildlife, boat traffic, pollution, and poor visibility; facilities; lack of hydration; condition of my equipment; my personal health and fitness; and/or the actions of other people including but not limited to participants, volunteers, spectators, event organizers, and course monitors. My participation in this event is purely voluntary, and I choose to participate with the knowledge of the risks of participation. I agree that if at any time (including during the event) I am no longer willing or able to participate in the event, I will contact an official and remove myself from the event.
I understand that Arms Around Bainbridge, in its own discretion, may remove an individual from the event if they are creating a risk to themselves or others. I also understand that Arms Around Bainbridge, in its own discretion, may cancel the event at any time without refund if it deems it necessary for the safety of participants.
I hereby consent to receive medical treatment in the event of accident, injury, and/or illness to me during this event.
If I’m participating in the relay swim around the island, I certify that I am 18 or older on the date of the event.
I consent to Arms Around Bainbridge taking photos and/or videos of me during the event. I give Arms Around Bainbridge permission to post photos and videos of me on their website and Facebook page and use the photos and videos in other materials and events promoting Arms Around Bainbridge.
RELEASE AND INDEMNITY AGREEMENT
I agree and bind my executors, administrators, heirs, next of kin, and successors to:
(a) irrevocably waive, release and discharge Arms Around Bainbridge and its directors, employees, officers, volunteers, event participants, sponsors and agents from any and all claims and liability for my death, disability, personal injury, property damage, property theft, or any other acts of nature or disruption which may happen to me while participating in the open water swim; and
(b) indemnify, defend and hold harmless Arms Around Bainbridge and its directors, employees, officers, volunteers, event participants, sponsors and agents from any and all claims and liability made by any other individuals or entities as a result of any of my actions during this event.
This waiver includes any losses claimed to be caused in whole or in part by the negligence of Arms Around Bainbridge or its directors, employees, officers, volunteers, event participants, sponsors and agents and includes claims for personal injury, property damage, wrongful death, products liability, breach of contract or otherwise.
I agree that this document is governed by the laws of the State of Washington.
This agreement constitutes the complete and sole agreement between you and Arms Around Bainbridge, its employees, officers, directors, volunteers, event participants, agents and all others associated with Arms Around Bainbridge. If any portion of this document is deemed unlawful or unenforceable, it shall not affect the enforceability of the remaining provisions and the remaining provisions shall continue in full force and effect.
ALL PARTICIPANTS (EVEN THOSE UNDER 18)
BY CHECKING THE BOX BELOW NEXT TO “I AGREE” I AM VERIFYING THAT I HAVE READ THIS WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
